Information about the processing of personal data

Introduction

The processing of personal data is subject to strict legal requirements within the European Union. We, Streamdiver GmbH, take our responsibility as a data processor very seriously and strive not only to ensure the protection of your data, but also to provide you with all relevant information as to why and how we collect, process and store such data as transparently as possible. Therefore, please take the time to read this information carefully and contact us directly if you have any questions about it.

Processing of personal data

Personal data (also referred to as “data” below) is any information relating to an identified or identifiable person (for example: name, contact details, billing details, IP address).

According to Article 4 paragraph 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as “GDPR”), “processing” means any process carried out with or without the aid of automated processes or any such series of processes in connection with personal data, such as the collection, recording, organization, storage, adjustment or change, reading, querying, use, disclosure through transmission, dissemination, or other Form of provision, reconciliation, or Linking, restricting, deleting, or destroying.

Privacy statement

With the following privacy policy, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide on the purposes and means of processing, either alone or together with others.

Information about our data processing

We process your data in various ways, depending on whether you

  • visit our website,
  • use our streaming platform
  • are interested in our products and services, or
  • customer, representative, or employee of our customers, suppliers, or business partners; or
  • Are applicants for employment in our company.

If we offer a contact option via an input mask on our website, streaming platform or in our support portal, the information entered is transmitted in encrypted form via the HTTPS protocol. Please note that the confidentiality of other communications on the Internet, in particular via e-mail, is not guaranteed, and we therefore recommend that you refrain from transmitting confidential data and information by email.

Website visitors, platform users, newsletter subscribers and interested parties

In principle, we process your personal data either

  • to protect our legitimate interests (Article 6 (1) (f) GDPR), namely ensuring the operation, security and optimization of our website and streaming platform, or
  • to send our newsletter to people if you have signed up for it (Article 6 (1) (a) GDPR), or
  • to process your inquiries that you submit to us via the contact form on our website, via our streaming platform or our support portal, by e-mail or telephone (Article 6 (1) (a) GDPR).

You give us your consent (Article 6 (1) (a) GDPR) by subscribing to the newsletter or by sending or submitting the request to us.

For technical reasons, certain data and information must be collected and stored when you visit our website, e.g. the pages used, the time and duration of the visit, and data provided by the browser used (e.g. about the operating system and the system settings used). We use this data and information anonymously to make our offer as user-friendly as possible and to be able to technically optimize it. The web server is located in Austria. The data is not used to personally identify visitors to this website.

Cookies

We use “cookies” on our website and platform to a very limited extent. Cookies are small text files or codes that contain units of information. These text files are stored on your hard drive or in your browser's memory when you visit one of our websites.

We only use cookies to ensure the functioning of our website and platform. We do not need consent to use such cookies, which is why you will not see annoying cookie banners on our website and platform.

How long do cookies remain stored on my device?

The length of time a cookie stays on your device depends on whether it is a persistent cookie or a session cookie. Session cookies only remain on your device until your browser session is ended. Persistent cookies remain stored on your device, even after you have ended a browser session, until the default cookie retention period has expired or is deleted.
You can prevent the use of cookies by setting your browser software accordingly. However, in this case, it may not be possible to use all functions of our websites to their full extent.

Analytics

Our website, our streaming platform and our digital dialogue with our customers (e.g. newsletter) use Matomo, a web analysis service operated by ourselves. Matomo uses cookies, which enable us to analyze the use of our website.

For this purpose, the usage information generated by the cookie (including your abbreviated IP address) is transferred to our server and stored for usage analysis purposes, which serves to optimize our website. During this process, your IP address is immediately anonymized so that you remain anonymous to us.

If you do not agree to the storage and evaluation of data in connection with your visit to and use of our website or streaming platform, you can object to storage and use at any time (see also terms of use for the streaming platform). In this case, a so-called opt-out cookie is stored in your browser, which means that Matomo does not collect any session data.

Should you provide personal data or information on our websites, we may continue to use it within the framework of the legal requirements of the TKG without your further consent. This does not apply to use for advertising or marketing purposes or transfer to third parties, which requires your prior separate consent.

This website also uses HubSpot, a service provided by HubSpot Inc., a software provider from the USA with branches in Ireland (HubSpot Inc., 2nd Floor 30 North Wall Quay, Dublin 1, Ireland) and Germany (HubSpot Germany GmbH, Am Postbahnhof 17, 10243 Berlin), among others, which we use to cover various aspects of our online marketing. These include:

  1. Email marketing (newsletters and automated mailings)
  2. Social media publishing & reporting (e.g. LinkedIn, Facebook)
  3. Google Ads
  4. Reporting (e.g. traffic sources, accesses, etc....)
  5. Contact management (e.g. user segmentation & CRM)
  6. Provision of contact forms and appointment bookings (calendar tool)
  7. Delivery of landing pages and live chat

HubSpot uses “cookies,” which are stored on your computer and allow us to analyze your use of the website. HubSpot evaluates the information collected on our behalf to generate reports about your visit and the pages you have visited. If you generally do not want cookies to collect data, you can prevent cookies from being saved at any time by changing your browser settings accordingly.

The data we collect using HubSpot is used by us exclusively to provide and optimize our marketing. Your data can then be used by us to contact you as a visitor to our website and to determine which services offered by our company are of interest to you. If you subscribe to our email news and download studies and other documents, HubSpot also allows us to personally record your visits using your additional information (in particular name/email address) and, if necessary, inform you in a targeted manner about topics you prefer. Where required by law, we will first and separately ask you for your consent to collect, store and process your data. You can withdraw this consent at any time.

  5. Recipient: HubSpot Inc
Third-party websites

Our website may contain links to other websites from third parties. The data processing practices of such third-party websites are subject to the privacy statements of the respective website. We recommend that you study the privacy policies of these websites to get an overview of the data processing processes of the respective third party provider. We are generally not responsible for content offered on these external sites, both with regard to data protection and the technical security of the data and information provided. In this context, please note that external providers may use technologies to personalize advertising.

In principle, we process your personal data either

  • to carry out pre-contractual measures or to fulfill our contractual obligations (Article 6 (1) (b) GDPR) within the framework of the mandate relationship,
  • based on your express consent (Article 6 (1) (a) GDPR), or
  • to fulfill our legal obligations (Article 6 (1) (c) GDPR).

The purpose of processing your data is to carry out and process our contractual relationships and to provide our services. If we are not provided with the necessary data, we will not be able to enter into a business relationship.

(Representatives/Employees of) suppliers and business partners

In principle, we process your personal data either

  • to carry out pre-contractual measures or to fulfill our contractual obligations (Article 6 (1) (b) GDPR); or
  • to comply with our legal obligations (Article 6 (1) (c) GDPR)

The processing of your data is primarily used to initiate, maintain and process our contracts for goods and services. If we are not provided with the necessary data, we cannot enter into a contractual relationship.

Data processing of applicants

In principle, we process your personal data either

  • to implement pre-contractual measures (conclusion of a service contract, Article 6 (1) (b) GDPR),
  • based on your express consent (Article 6 (1) (a) GDPR), if we would like to keep you in evidence as an applicant, or
  • to fulfill our legal obligations (registration as an employee with social security, Article 6 (1) (c) GDPR).

The purpose of processing your data is to complete the application process and, if necessary, to register with social security if we hire you. If you do not provide us with your information, we will not be able to process your application.

Collection of personal data from sources other than the data subject himself (Art 14 GDPR)

When we process your data, we generally receive this data from you yourself. Nevertheless, in individual cases, we may also obtain data from other sources. These other sources are exclusively publicly available information that we obtain from public registers, the Internet or, in individual cases, from credit agencies. The data that we obtain about you from third sources and store in our systems is limited to contact information (email address and telephone number, postal address), as well as to your role in the company for which you work. This processing is based on our legitimate interest in a complete set of data about you required for professional communication and the processing of the business relationship, depending on the relationship we have with you or with the company for which you work (Art 6 (1) (f) GDPR).

How long is your data stored?

We will only store your data for as long as is necessary for the purposes for which we collected your data.

However, for tax reasons, we generally store contracts and other documents as well as related correspondence arising from contractual relationships for a period of ten years.

Due to legal limitation periods and resulting evidence requirements, the storage period in connection with business relationships may also correspond to the respective statutory limitation period.

Your rights?

We would also like to inform you that you have the right at any time to

  • to request information about which data we process about you (see in detail Art 15 GDPR),
  • have the right to have your data corrected or deleted (see in detail Art 16 GDPR),
  • have the right to restrict the processing of your data (see in detail Art 18 GDPR),
  • have the right to object to data processing (see in detail Art 21 GDPR),
  • to assert the right to data portability (see in detail Art 20 GDPR).

If we process your data on the basis of your consent, you have the right to withdraw this consent at any time by e-mail or by post to the addresses given below. This does not affect the lawfulness of the data processing carried out up to this point in time (Article 7 (3) GDPR).

If, despite our obligation to process your data lawfully, there is, contrary to expectations, a violation of your right to lawful processing of your data, please contact us by post or email (see contact details below) so that we can learn about your concerns and address them. However, you also have the right to lodge a complaint with the Austrian Data Protection Authority or with another data protection supervisory authority in the EU, in particular at your place of residence or work.
